The Absolute Rule
This applies to ALL cannabis products including CBD, edibles, oils, vape cartridges, topicals, and even hemp-derived products. There are no exceptions.
Despite cannabis being legal in Canada, international borders are governed by federal and international law. Bringing cannabis into or out of Canada is an offence under the Cannabis Act, regardless of the legal status in the destination country.
CBSA Penalties
The Canada Border Services Agency (CBSA) enforces cannabis laws at all ports of entry:
- Undeclared cannabis: Penalties up to C$2,000
- Criminal penalties: Up to 14 years imprisonment under the Cannabis Act for import/export
- In 2025, CBSA seized over 46,608 kilograms of illegal cannabis at borders

Americans visiting Canada for cannabis face unique risks that many don't fully appreciate:
US Preclearance at Canadian Airports
Several Canadian airports have US Preclearance facilities where US Customs and Border Protection (CBP) officers operate on Canadian soil. Before entering the Preclearance zone:
- You must have zero cannabis on your person or in your luggage
- Some airports provide disposal bins before the Preclearance zone
- CBP enforces US federal law, under which cannabis remains Schedule I
Admitting Cannabis Use
Admitting cannabis use to a CBP officer — even legal use in Canada — can result in:
- Enhanced scrutiny at every future crossing
- Device searches (phones, laptops)
- Database flagging for future crossings
Non-Citizen US Residents
For green card holders, visa holders, and other non-citizen US residents, the risks are even more severe:
- Denial of entry to the United States
- Lifetime inadmissibility
- Deportation proceedings
Immigration attorneys generally advise not volunteering information about cannabis use when crossing back to the US. Never lie to a federal officer — this is a separate crime. If asked directly, you may decline to answer, though this may trigger additional scrutiny.
Between Two Legal Countries
Even traveling between two countries where cannabis is legal (for example, Canada and Uruguay), it is still illegal to bring cannabis across the border. International aviation law, transit country laws, and the originating and destination countries' import/export rules all apply.
The Bottom Line
Enjoy cannabis legally while in Canada. Purchase what you need from a licensed Canadian retailer. Dispose of all cannabis products before approaching any international border or US Preclearance facility. This is not optional — it is the single most important rule for cannabis tourists in Canada.
