Cannabis Remains Federally Illegal in the US
While cannabis is legal in many US states, it remains Schedule I under US federal law. US Customs and Border Protection (CBP) enforces federal law at all ports of entry and US Preclearance locations in Canadian airports. The disconnect between Canadian federal legality and US federal prohibition creates real risks for American visitors.
US Preclearance at Canadian Airports
Several major Canadian airports have US Preclearance facilities where CBP officers operate on Canadian soil. Before entering the Preclearance zone:
- You must have zero cannabis on your person, in your bags, or in your luggage
- Some airports provide disposal bins before the Preclearance zone
- CBP officers enforce US federal law — cannabis is illegal regardless of Canadian legality
What Happens If You Admit Cannabis Use
Admitting cannabis use to a CBP officer — even legal use in Canada — can result in:
- Enhanced scrutiny at every future border crossing
- Device searches of phones, laptops, and cameras
- Database flagging that follows you permanently
- Significantly longer processing times at borders
Special Risks for Non-Citizens
For green card holders, visa holders, and other non-citizen US residents, the risks are dramatically more severe:
- Denial of entry to the United States
- Lifetime inadmissibility — a permanent ban from entering the US
- Deportation proceedings
- These consequences can result from merely admitting cannabis use, not just possession
Immigration attorneys generally advise not volunteering information about cannabis use when crossing back to the US. Never lie to a federal officer — this is a separate crime. If asked directly, you may decline to answer, though this may trigger additional scrutiny.
How to Protect Yourself
- Purchase and consume cannabis only in Canada — never bring any across the border
- Dispose of all cannabis products before approaching any border crossing or Preclearance facility
- Do not photograph cannabis on your phone if you're concerned about device searches
- Do not discuss cannabis use on social media tied to your real identity before crossing

Coming Into Canada
The Canada Border Services Agency (CBSA) also prohibits bringing cannabis into Canada. Even if you're bringing cannabis from a US legal state into a Canadian legal province, it is illegal. Penalties include fines up to C$2,000 and criminal charges.
